LM Image Gallery
By purchasing any product from LM Image Gallery, the customer agrees to the following Terms and Conditions. It is recommended that these conditions be read carefully prior to placing an order. By completing a purchase, the customer acknowledges acceptance of these terms.
LM Image Gallery reserves the right to modify these Terms and Conditions at any time without prior notice.
Orders
All artworks offered by LM Image Gallery are produced to order. Once an order has been placed and payment has been processed, it cannot be cancelled, modified, or refunded.
Due to the custom nature of the products, LM Image Gallery does not accept returns or exchanges for change of mind.
Customers are responsible for ensuring that all order details, including artwork selection, sizing, framing options, and shipping information, are correct at the time of purchase.
Pricing & Payment
All prices are listed in Australian Dollars (AUD) unless otherwise stated.
Payment must be made in full at the time of purchase. LM Image Gallery reserves the right to change pricing at any time without notice.
All payments are processed through secure third-party payment providers. LM Image Gallery does not store payment details.
Production Timeframe
All artworks are produced in Australia using professional-grade photographic printing materials, mounting substrates, and framing components.
Production typically requires approximately 3–4 weeks, depending on the product specifications. Shipping and handling generally require an additional 3–5 business days, depending on the destination.
Each artwork undergoes careful inspection throughout the production and framing process to ensure quality before being securely packaged for delivery.
Production and shipping timeframes are estimates and may vary depending on production schedules, supplier availability, or shipping carrier delays.
Shipping and Delivery
LM Image Gallery takes every reasonable precaution to ensure artworks are packaged securely for safe transit.
Once an order has been dispatched, delivery is handled by third-party shipping providers. LM Image Gallery is not responsible for delays caused by shipping carriers, customs processes, or unforeseen logistical disruptions.
Customers are responsible for providing accurate delivery details. LM Image Gallery is not liable for lost shipments resulting from incorrect address information supplied by the customer.
Damaged Deliveries
Customers must inspect their order immediately upon receipt.
If an item arrives damaged in transit, the customer must notify LM Image Gallery within seven (7) days of delivery. Claims submitted after this period may not be accepted.
Customers must retain:

Photographs documenting the damage and packaging
This information may be required in order to process a damage claim with the shipping provider.
LM Image Gallery reserves the right to determine the appropriate resolution, which may include repair, replacement, or another remedy deemed suitable.
Damage claims may be declined if the packaging has been discarded, the artwork has been altered, or the damage appears to have resulted from misuse or mishandling after delivery.
Photographic Prints
All unframed photographic print purchases are final. LM Image Gallery does not offer exchanges or refunds for change of mind.
If a print arrives damaged during transit, the customer must notify LM Image Gallery within seven (7) days of receipt.
Books and printed publications sold by LM Image Gallery are non-refundable and non-returnable.
Framed Photographic Prints
Framed artworks are custom produced and are therefore non-returnable and non-exchangeable once an order has been placed.
Every effort is made to ensure that framed artworks are packaged safely. In the event of transit damage, the customer must notify LM Image Gallery within seven (7) days of delivery.
Customers must retain all packaging materials and provide photographic documentation if requested.
Product Variations
Due to the nature of photographic printing and digital display technology, colours and tonal variations may appear slightly different between on-screen images and the final printed artwork.
Minor variations in framing materials, finishes, or paper textures may occur depending on supplier availability. Such variations do not constitute defects.
Intellectual Property
All photographs, artworks, and written content displayed on the LM Image Gallery website and associated materials remain the exclusive intellectual property of LM Image Gallery and the respective artist.
All works are protected under Australian Copyright Law and international copyright regulations.
Images and content may not be copied, reproduced, distributed, downloaded, modified, or used for personal, editorial, or commercial purposes without prior written permission from LM Image Gallery.

Privacy and Data Protection
LM Image Gallery respects customer privacy and is committed to protecting personal information.
Customer information such as name, address, email, and contact details is collected solely for the purpose of order processing, shipping, and customer communication.
Personal information will not be sold, shared, or disclosed to third parties except where necessary for payment processing or shipping services.
Limitation of Liability
To the maximum extent permitted by law, LM Image Gallery shall not be liable for:

Liability is limited to the purchase price of the product.
Services and products are provided on an “as is” basis without warranties, except where required by law.
Governing Law
These Terms and Conditions are governed by the laws of Australia. Any disputes arising from the purchase of LM Image Gallery products shall be subject to the jurisdiction of the appropriate Australian courts.
Installation and Handling
All framed artworks supplied by LM Image Gallery must be handled and installed with appropriate care.
LM Image Gallery is not responsible for damage resulting from improper handling, installation, hanging methods, or environmental conditions after delivery. Customers are responsible for ensuring that artworks are installed using suitable hardware and wall fixtures appropriate for the weight and size of the framed piece.
LM Image Gallery recommends that larger or heavier framed artworks be installed by a qualified professional. LM Image Gallery accepts no liability for injury, property damage, or loss resulting from incorrect installation or inadequate wall support.
Customers should avoid placing artworks in environments exposed to excessive humidity, direct sunlight, heat sources, or other conditions that may affect the longevity of the materials.
Commercial Use and Licensing
All artworks purchased from LM Image Gallery are sold as physical art objects only.
The purchase of an artwork does not transfer copyright or reproduction rights to the buyer. Ownership of the physical print or framed artwork does not grant permission to reproduce, publish, distribute, scan, copy, or otherwise use the image for commercial, promotional, or editorial purposes.
Any commercial use, reproduction, or licensing of images must receive prior written permission from LM Image Gallery and may require the purchase of a separate licensing agreement.
Unauthorised reproduction or use of any image may constitute a breach of Australian Copyright Law.
Limited Editions and Authenticity
Certain artworks offered by LM Image Gallery may be produced as limited editions.
Where applicable, LM Image Gallery reserves the right to determine edition sizes, formats, and print specifications. Limited edition artworks may be accompanied by documentation verifying authenticity.
Edition sizes apply to a specific size and format of the artwork. LM Image Gallery reserves the right to produce the same image in different sizes or formats unless explicitly stated otherwise.
All artworks are produced using professional photographic printing processes and archival-quality materials designed for longevity when displayed under appropriate conditions.
Force Majeure
LM Image Gallery shall not be held liable for any delay or failure to perform its obligations where such delay or failure results from events beyond its reasonable control.
These events may include, but are not limited to, natural disasters, acts of God, fire, flood, severe weather, pandemic, government restrictions, labour disputes, supply chain disruptions, material shortages, transportation interruptions, power failures, or failures of third-party service providers.
In such circumstances, LM Image Gallery reserves the right to extend production and delivery timeframes as necessary. Customers will be notified of significant delays where reasonably possible.
LM Image Gallery shall not be responsible for any loss, damage, or inconvenience arising from such delays.
Colour and Image Representation
LM Image Gallery makes every effort to display photographic artworks as accurately as possible on its website and promotional materials. However, colours, brightness, contrast, and tonal range may vary depending on individual screen settings, device displays, lighting conditions, and browser configurations.
As a result, the appearance of an artwork on a digital screen may differ slightly from the final printed photograph.
Such variations are considered normal and do not constitute a defect or fault in the product. For this reason, differences between on-screen images and the final printed artwork are not grounds for return, exchange, or refund.
Customers acknowledge and accept that photographic prints are physical objects produced through professional printing processes, and minor variations in tone, colour, and finish may occur.
Artwork Care Guide
To ensure the longevity and appearance of your photographic artwork, LM Image Gallery recommends following the care guidelines below.
Display Environment
Photographic prints and framed artworks should be displayed in stable interior environments.
Avoid placing artworks in areas exposed to:

Direct sunlight or prolonged UV exposure

Excessive heat or proximity to heating vents

High humidity such as bathrooms or kitchens

Significant temperature fluctuations
These conditions may affect the longevity of photographic materials and framing components.
Handling
When handling your artwork, always ensure hands are clean and dry. Framed artworks should be lifted and carried using both hands, supporting the frame from the sides.
Avoid touching the surface of the photographic print or acrylic glazing, as fingerprints and oils may affect the finish.
Cleaning
Frames and glazing should be cleaned gently using a soft, dry microfiber cloth.
If necessary, a small amount of glass cleaner may be applied to the cloth, not directly to the artwork or frame.
Avoid using abrasive materials, solvents, or household chemicals on any part of the artwork.
Installation
Framed artworks must be installed using appropriate wall fixtures suitable for the weight and size of the piece.
LM Image Gallery recommends professional installation for larger framed works to ensure proper support and safety.
Long-Term Care
When displayed in suitable conditions and handled with care, professional photographic prints and framing materials can maintain their visual quality for many years.
If artworks need to be stored, they should be kept in a dry, temperature-controlled environment and protected from dust, moisture, and direct light.
